Is Marriage Registration Mandatory For Passport Verification

Marriage certificate is an official document certifying the marriage of two people under a relevant Act. When registering a marriage, a certificate will be issued by the marriage registrar. Procedure to register marriage in India

The Hindu Marriage Act, 1955 or the Special Marriage Act, 1954 both allow for the registration of marriages in India. The Supreme Court of India in 2006 declared it mandatory to register marriages.


Online registration for a marriage certificate

Presently, marriages could be registered online which is preferred as it can save time and is less troublesome, as no need to stand in long queues would be there. Steps required to obtain marriage certificate online are as follows-

  • State government’s official website has to be opened where the applicant belongs to

  • Form for registration should be looked for after browsing the website.

  • The required details as provided in the form should be filled

  • Submit the form after filling the details.

After submitting the form, the marriage registrar will summon the applicant on the date and time as provided by him. It is important that the parties are to be present at the office of the marriage registrar at the time with the required documents. Two witnesses should also be present at the marriage registrar’s office, who were also present during the wedding.

Offline registration procedure for a marriage certificate

Under the Hindu Marriage Act, 1955

  • Couples married as per the Hindu, Buddhist, Sikh or Jain traditions and belonging to these communities, have to apply for marriage registration under this Act.

  • The couple would have to visit the office of the Sub-registrar under whose jurisdiction the marriage was solemnised.

  • As per the customary practices and rituals of either of the parties, a Hindu marriage can also be solemnised.

Under the Special Marriage Act, 1954

  • As provided under the Act, all citizens of India can get their marriage registered under the Act of 1954.

  • If the couple file for the court marriage under this Act, the certificate of registration would be issued by the marriage officer as well.

  • A period of 30 days will be provided for any objection, in case no objection has been raised to the marriage, the officer will issue a certificate to the couple.

  • The whole procedure can be completed without following any of the customs.

How to file for registration?

  • Marriage can be registered through both online and offline procedures.

  • The online registration of marriage can be done in major cities in the country.

  • For the marriage procedure offline, one would have to file for registration in the office of the sub-registrar of the place where their marriage got solemnised.

Marriage Certificate no longer a compulsion for passport

  • To make the process easier the government has introduced a number of changes in the Passport rules and has released new Passport rules in December 2016.

  • Previously, married applicants had to provide Annexure K or any marriage certificate. Now with the introduction of change in the rules, applicants for Passport are required to submit the marriage certificate or divorce decree in case they are separated or divorced. The applicant also has no need to mention the name of the former spouse in the application as well.

  • Marriage registration Certificate will be needed as proof of marriage in foreign embassies in India and foreign countries outside the country. When applying for a Spouse VISA, the foreign Embassies will ask for Marriage Registration Certificate.
