Legal Metrology Act and Rules

The Legal Metrology Act, of 2009 was implemented in India to establish consistent weight and measurement standards. Beginning on April 1, 2011, the Act went into effect. The area of metrology known as "legal metrology" examines measurement units, measurement techniques, and measurement instruments about the necessary legal and technical requirements to guarantee the public's assurance of the security and accuracy of the measurements and weights.

Relevance

The guidelines of Legal Metrology apply to:

  • Anyone utilizing a weight or measure in a transaction, industrial production, or protective measure

  • Producer, Merchant, Distributor, Broker, Fixer of any weight or measure, Importer, and/or

  • Packager of any good associated with weight, measure, and figures.

PRIMITIVE STAKEHOLDERS

  • Manufacturer: An individual who produces weight or measure, any packaged good, one or more components, and then obtains more parts of the same weight or measure and, following assembly of those parts, declares the final result to be a weight or measure that he produced.

  • Dealers are those who engage in the direct or indirect business of purchasing, selling, supplying, or distributing any weight or measure in exchange for cash.

  • Packer: A packer is an individual or business that prepares goods for sale in units appropriate for wholesale or retail, using bottles, tins, wrappers, or other containers.

  • Importer: Any person, business, or organization that imports products into a customs territory or arranges for the importation of commodities from a foreign nation is an importer.

  • Repairer: An individual who fixes weights or measures, including those who clean, lubricate, adjust, paint, or provide any other service to guarantee that the weights or measures meet the requirements outlined in the Legal Metrology Act

ESSENTIAL COMPLIANCES

Weights and Measures Manufacturer, Repairer, and Dealer Licencing

  • All weights and measures manufacturers, repairers, and dealers must apply for and receive a license from the Controller of Legal Metrology.

  • Name, address of the premises, commodity name, and the necessary fee which varies depending on the state must be included with the application.

Registration of Commodity Manufacturer, Packer, or Importer: The Legal Metrology (Packaged Commodities) Rules, 2011 mandate that all manufacturers, packers, and importers of commodities who pre-pack or import any product for sale, distribution, or delivery register.


The Legal Metrology Act requires mandatory declarations for the following activities: manufacturing, packing, selling, importing, distributing, delivering, offering, exposing, or possessing any pre-packaged item for sale in standard numbers or quantities. Every box or pre-packaged commodity meant for Indian commerce must bear an obligatory declaration. It is necessary to include the following declarations on the packages:

  • The manufacturer, packer, or importer's name and address

  • The commodity's common or generic name

  • Origin Nation

  • The content's net quantity

  • The producer, packaging, or import's month and year

  • The commodity's "best before" or "expiration date," "month," and "year"

  • Price at retail: MRP (total taxes included)When applicable, the commodity's size and dimensions

  • The weight and measurements that are immovable are checked and stamped at the site of the object.
