The Special Marriage Act, 1954 provides for the procedure of court marriages in Delhi. The total time required to complete the procedure for court marriage, from submitting the application form to receiving the marriage, may take from a period of 30 days to 90 days in some instances. However, after the documents have been verified, all that is required of you would be your presence before the Marriage Officer on the date provided by him and you can have your marriage certificate issued after signing the required documents. The procedure for court marriage registeration in delhi has been explained as under-
Procedure-
A notice for the marriage would be sent to the Marriage officer first of all. The Marriage Officer must have jurisdiction over the area where either of the parties have stayed for a period of 30 days or more while such notice has been filed.
The notice so submitted to the Marriage Officer, would have to be published in the office of the Marriage Officer, in order for it to be visible to the general public, for a period of 30 days.
The objective behind publishing the notice is that any person can raise an objection to the marriage on the grounds provided under Section 4 of Chapter II of the Act.
If an objection has been raised against the notice to the marriage, the Marriage Officer would then inquire about the validity of the objection raised within a period of 30 days from the date such notice was published. If the objections so raised are found to be true, the marriage cannot be solemnised.
In this situation, the aggrieved party have the right to file for an appeal in the respective District Court within a period of 30 days from the date such application for court marriage was cancelled.
When no objection against the marriage notice has been raised or the objection so raised was found to be invalid, the parties to the marriage will have to present before the Marriage Officer along with their witnesses on the date provided by the marriage Officer.
After the necessary procedure, a marriage certificate will be issued by the Marriage Officer, which shall include the signatures of the parties, witnesses as well as the Marriage Officer. This marriage Certificate shall be a conclusive proof of the marriage.
Conditions required-
As has been mentioned under the Chapter II, Section 4 of the Act, conditions required to be fulfilled for the marriage registration in Delhi are-
In case the parties applying for court marriage were married before to some other person, the application in such a case would be denied. Therefore, the parties must not be married to another party when applying for court marriage.
Parties should be competent to provide their valid consent, therefore must not be of unsound mind and must be entering the marriage of their free will.
The groom must be 21 years old or above and the bride must have completed 18 years of age.
The parties shall not fall within prohibited degrees of relationship.
